1) is an act of the parliament of the united kingdom which creates an offence in england and wales of inciting hatred against a person on the grounds of their religion. The act will ensure that the criminal law protects all groups of persons defined by their religious beliefs or lack of religious belief from having religious hatred intentionally stirred up. Prosecutors are reminded to read this guidance with our public statement on racist and religious hate crime as it provides greater detail on some of the key areas of the policy.
It also amends section 24a of the police and criminal evidence act 1984 so that the powers of citizen‘s arrest do not apply to the offences of stirring up religious and racial hatred.
Subsection 29l (3) states that the maximum penalty for a conviction for an offence of stirring up religious hatred is seven years in prison. (1) a person who uses threatening words or behaviour, or displays any written material which is threatening, is guilty of an offence if he intends thereby to stir up religious hatred. Against this backdrop, this chapter examines how religious hatred came to be seen in parliament as a sufficiently pressing issue to warrant inclusion within the stirring up hatred offences, including questions of how it was positioned alongside racial hatred and as a public order issue. The 2006 act criminalises expressions of hatred against individuals on the basis of their religious beliefs or lack thereof, filling a gap left by the race relations act 1976, which only addressed racial hatred.
